Copyright is concerned exclusively with the expression of the idea on which a work is based. Various types of work are eligible for copyright protection. Examples of works include books, photographs, graphic works, sculptures, logos, works of architecture, films, paintings, music, computer programs, sound recordings, broadcasts, typographical arrangements and etc.

VOLUNTARY NOTIFICATION

Copyright arises automatically upon the creation of a work without the need for any form of registration. Indeed, no registration system exists in Malaysia for the registration of copyright. Notwithstanding this, the Copyright Act provides for a notification mechanism of the existence of copyright in a work to be made to the Controller of Copyright or MyIPO. This notification mechanism allows copyright owners to obtain certificates issued by Controller of Copyright and this certificate serves as a proof of ownership of copyright.  

COMPLETION TIMELINE​​

 

Generally, it takes between 3 to 5 months for a voluntary notification of copyright to be completed.

DURATION OF COPYRIGHT

 

As a general rule, the duration of copyright for authors’ works (literary, musical and artistic works) is the life of the author plus 50 years after his death.

COPYRIGHT PROTECTION

Although copyright comes into existence automatically, notification of copyright has become increasingly popular. This is because certificate of copyright notification is very useful when a copyright owner wishes to license his/her copyright to another party or even assigning his/her copyright outright. Furthermore, a certificate is also useful when when seeking for investors or sponsors.
