How to Protect Trademark Symbol Brand Logo
Trademark is what we commonly call ‘brand’. A trademark acts as an effective indicia to enable customers to recognise your goods and services. An effective trademark leaves a lasting impression on your customers within a few seconds of sighting and this in turn facilitate the propagation of your brand across your target customers.
SELECTION OF CLASSES
Under the existing registration mechanism, there are 45 classes of goods and services for you to choose from. This is known as Nice Classification.
As a starting point, you first narrow down your scope by selecting the classes which contain your existing goods/services and slowly expanding your application option to other potential goods/services which you plan to introduce to the market in the future. Depending on your business needs, we will advise you on the selection of classes.
COMPLETION TIMELINE
In Malaysia, a straightforward application of trademark (without objection and opposition) takes between 12 to 18 months to complete. An expedited examination is possible in appropriate circumstances.
VALIDITY PERIOD
Once registration is successful, the registration lasts for a period of 10 years calculated from the date of submission of application. Trademark registration may be renewed every 10 years for an indefinite time.
TRADEMARK PROTECTION
Once you have filed an application, you may apply a ‘TM’ sign on your trademark. Upon registration, you are allowed to place ® on your trademark to give notice to the public that your mark is protected by registration.
Trademark protection is limited to the jurisdiction where the registration is granted. This means that if you wish to obtain protection overseas, you will have to approach the respective trademark offices. However, there are international filing mechanisms that facilitate the registration of trademark in multiple jurisdictions such as the Madrid Protocol and the Paris Convention.
