Seizing Counterfeit Goods - The Weapon of a Trademark Owner

Perhaps one of the greatest weaponry of a registered trademark against trademark infringement is the ability to initiate seizure action with the assistance of the Domestic Trade and Consumer Affairs Ministry (KPDNHEP). Recently, the enforcement team of the Ministry based in Johor successfully carried out enforcement action and seized 112,350 units of suspected counterfeit face masks.


The action was taken pursuant to powers granted under the Trade Description Act 2011.



Many may not aware that trademark registration does not cost a bomb and the advantages of registering trademarks are immeasurable in the long run. TRADEMARK PROTECTION

Once you have filed an application, you may apply a ‘TM’ sign on your trademark. Upon registration, you are allowed to place ® on your trademark to give notice to the public that your mark is protected by registration.

Trademark protection is limited to the jurisdiction where the registration is granted. This means that if you wish to obtain protection overseas, you will have to approach the respective trademark offices. However, there are international filing mechanisms that facilitate the registration of trademark in multiple jurisdictions such as the Madrid Protocol and the Paris Convention.
